Terms of Service

These Terms of Service ("Terms") govern your access to and use of StayCare ("StayCare", "we", "us"), a software platform that lets short-term-rental hosts offer optional add-on products and services to their guests. By creating an account or placing an order through a host's guest link, you agree to these Terms.

1. Who we are

StayCare is a sole proprietorship based in Calgary, Alberta, Canada. For questions about these Terms, contact staycare@mail.com.

2. The service

StayCare provides hosts with a guest-facing storefront ("Guest Hub") where guests can browse and order items (groceries, welcome packs, transfers, eSIMs, experiences and similar add-ons) prior to or during their stay. Hosts are responsible for the products, pricing, fulfilment and customer service for orders placed through their Guest Hub. StayCare is the technology provider; we are not the seller of the goods or services unless explicitly stated.

3. Host accounts

  • You must be at least 18 years old and legally able to operate a short-term-rental business.
  • You must provide accurate company, tax and Stripe Connect onboarding details.
  • You are responsible for the lawfulness of every product you list, including any required licences (alcohol, food handling, transport, etc.).
  • You are responsible for keeping your account credentials confidential.

4. Guest orders and payments

Payments are processed by Stripe Connect. When a guest pays, funds settle to the host's connected Stripe account, minus Stripe processing fees and any platform fee disclosed at checkout. StayCare does not hold guest funds.

5. Refunds and cancellations

Refunds are governed by our Refund & Cancellation Policy. During the beta, refund requests must be submitted within 7 days of purchase. Eligibility may depend on the service purchased, delivery status, and host fulfilment status. Hosts are required to honour this policy as a condition of using StayCare.

6. Acceptable use

  • No illegal goods or services, no firearms, no controlled substances, no items that violate Stripe's restricted business list.
  • No misleading product descriptions, fake reviews, or hidden fees.
  • No use of StayCare to send unsolicited marketing or to scrape another host's catalogue.

We may suspend or terminate accounts that breach these rules, with or without notice when guest safety or platform integrity is at risk.

7. Fees

During the beta period StayCare is offered free of platform fees to onboarded hosts. We will give at least 30 days' written notice before introducing any platform fee.

8. Intellectual property

StayCare retains all rights to the platform, branding, and software. Hosts retain ownership of their own content (property names, photos, product copy) and grant StayCare a non-exclusive licence to display that content as needed to operate the service.

9. Disclaimers

StayCare is provided "as is" during the beta. We do not guarantee uninterrupted availability and we are not liable for losses arising from a host's own fulfilment failures, third-party service outages (including Stripe), or events outside our reasonable control.

10. Limitation of liability

To the maximum extent permitted by law, StayCare's total liability arising out of or relating to these Terms is limited to the greater of (a) the fees you paid to StayCare in the 12 months preceding the claim, or (b) CAD $100.

11. Changes

We may update these Terms. Material changes will be announced by email to hosts at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.

12. Governing law

These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein. Disputes will be resolved in the courts of Alberta, Canada, unless local consumer-protection law requires otherwise.
